Online Divorce: How Long Does It Really Take?

Temps de lecture : 5 min

An online divorce can be finalized in a matter of weeks for a straightforward case, but negotiations or the division of real estate can extend the process by several months. There is no overall timeframe guaranteed by law. The key milestone is the 15-day cooling-off period after receiving the draft agreement, followed by the preparation, signing, and filing with the notary.

To file for divorce online, the spouses must first verify that they are eligible for a divorce by mutual consent without a judge. Each spouse must have their own attorney, and the agreement must cover both the separation and its consequences. Submitting documents through an online platform streamlines the process but does not eliminate any legal steps.

The Steps That Determine the Timeframe for an Online Divorce

Before accepting a promise of speed, ask what the starting point is: initial contact, submission of the complete application, or receipt of the agreement? These dates do not correspond to the same stage of the process.

Step Deadline to Note
Property Division, Child Support, and Agreement on the Consequences of Divorce Duration varies depending on the case and negotiations
Drafting of the proposal by the attorneys Duration to be confirmed with them once the information has been gathered
Time to consider the proposal after receiving it A mandatory 15-day period before any signature
Signature by the spouses and their attorneys Joint meeting after the expiration of the deadline for each party
Submission of the agreement to the notary Within 7 days of signing
Filing of the agreement by the notary Within 15 days of receipt

The 15-day period begins upon receipt of the draft

Article 229-4 of the Civil Code requires that the draft be sent by certified mail with return receipt requested. The time limit begins to run for each spouse upon receipt. It therefore does not begin upon payment of the flat fee or upon the opening of the case file. If the dates of receipt differ, the signing must wait until the time limit has expired for both spouses.

This is a period for reflection before signing, not a 15-day withdrawal period after signing. The attorneys verify the earliest possible date for signing.

The following 7 days and 15 days are maximum time limits

Article 1146 of the Code of Civil Procedure distinguishes between the submission to the notary within 7 days of signing and the filing within 15 days of receipt. These formalities may be completed earlier. Therefore, simply adding 15 + 7 + 15 does not yield either the minimum duration or the total duration of a divorce.

Is it necessary to travel even if you’ve prepared online?

Documents and preparatory correspondence may be exchanged remotely. However, the spouses and their attorneys must be present together to sign the agreement. The National Bar Council specifies that electronic signatures also require their physical presence in the same location.

To organize your schedule, be sure to check the meeting location and the availability of the four signatories. Going paperless simplifies the preparation process; its effectiveness also depends on coordination among the people involved.

What can cause the process to take longer?

An agreement that is still incomplete

It is not enough for both parties to want a divorce. The agreement must address the consequences of the separation: arrangements regarding the children, child support, any spousal support, and the division of assets. An unresolved dispute over housing or the children’s vacations can delay the drafting of the agreement. Articles 229-1 through 229-3 of the Civil Code govern this agreement and its contents.

A property to manage

Dividing a jointly owned home involves deciding on its future and settling financial matters between spouses. Depending on the chosen approach, you’ll need to gather appraisals, loan information, and the necessary legal documents. As Service Public explains regarding the division of property, the division of jointly owned or undivided real estate requires the involvement of a notary. It is also possible to arrange for the property to remain undivided; therefore, selling it before the divorce is not always mandatory.

A situation that requires a different procedure

Having minor children does not preclude a divorce without a judge. However, if a child capable of discernment requests to be heard by the judge, the process becomes a judicial one. Divorce by mutual consent is also not an option when one spouse is subject to a protective measure for adults. These situations must be disclosed from the outset; they involve more than just a few additional days of processing.

How can you put together your application without wasting time?

The most useful task is to anticipate the information that the attorneys will need to verify:

  • Ask them for a personalized list of documents: identification, civil status, marriage contract (if applicable), income, expenses, assets, and loans, depending on your situation.
  • Make a note of the points already agreed upon and those still to be discussed, including specific arrangements regarding housing, expenses, and the children.
  • Immediately report any real estate holdings or international circumstances so that the necessary procedures and recognition of the divorce abroad can be verified.
  • Request a step-by-step timeline specifying the required documents and the proposed date for the signing appointment.

When does a divorce become final?

Simply signing the agreement does not complete the process. Filing it with the notary gives it a definite date and makes it legally enforceable. The notary issues a certificate of filing; the formalities for updating civil status records must then be completed, as noted by Service Public regarding divorce by mutual consent.

Before committing, be sure to ask what the stated timeframe covers: a contract ready to sign, its actual filing, or the completion of civil registry formalities. It is this level of detail that allows you to compare timelines and make concrete plans for the next steps.
